Local Land Charge Searches

A Local Land Charge Search is split into 2 parts, the Local Land Charges Register and the Con 29.  The Land Charges Department holds the information for the register (LLC1) and information from various departments from the Local Authority are compiled to form the Con 29, thus completing a full search.

When purchasing a property your Solicitor may also carry out a Local Land Charge Search as part of the Conveyancing Process.  Under the Local Land Charges Act 1925, searches were made to make new purchasers aware of any obligations on the land or property that were binding to successive owners.

The statutory requirement is to return all searches within 10 working days
Land Charges Register we endeavour to send all full Local Land Charge Searches back within 4 working days.

Changes to Local Land Charges

From 1st April 2009 there were changes to the new CON29 (2007 Edition). The new CON29 comprises Required and Optional parts and now customers can submit Optional questions individually if required.  Each part is a standalone product that can be ordered separately if required. The new Question 22 on the new CON29 Optional form is designed for common land enquiries, but for a temporary period DEFRA has decided to retain the existing CR21 form.

LLC1 form

The LLC1 form shows information relating specifically to the property i.e. whether there are any planning applications, Tree Preservation Orders or Housing grants etc.

Con 29 form

The Con 29 form is divided into 2 parts, Part I and Part II.
Part 1 forms the basic search and relates to existing or proposed information to the property, i.e. road schemes, enforcement, planning history etc.
Part II questions require an additional fee and relate to additional information that maybe required including highways and footpaths.
Additional Enquiries can also be made; again there is an additional fee for these.

Refresh Searches

These can be submitted with a fee of £35 (within 6 months) quoting the original search number.  Refresh searches will only be accepted on full Con 29 and LLC1 search applications.

Personal Searches

A personal search can be carried out by anyone.  An appointment is made to view the local land charge register.   It is advisable to have knowledge about the register before viewing it and no information is given regards to the answers on the Con 29.

Personal Search Process:

Ring/ Email the local land charges department and give the following details:-
*Company Name
*Contact Number
*Address of site
*At least 4 days notice is required
A plan must faxed showing the site clearly marked.

Personal Search Fees

“The Government concluded that charging a fee for a Personal Search of the Local Land Charge Register was incompatible with the Environmental Information Regulations 2004(EIR) and the underlying 2003 EU Directive.  Following this conclusion the Government  revoked the £22.00 fee by amending the Local Land Charges Rules 1977.  The amendment came into force on the 17th August 2010. In light of this decision Bromsgrove District Council / Redditch Borough Council ceased to charge the fee with immediate effect”.

At present we are still awaiting more definitive instructions from Central Government, the LGA and the Local Land Charges Institute (LLCI) regarding refunds.  Once more is known, it will be communicated.

Caveat: Redditch Borough Council has noted that a search agent who has previously passed on the cost of the fee to its customer might be unjustly enriched by claiming a refund.  

The cost implications to this Authority is as yet not known.
