In the event of a tenant dying, the tenancy may pass to a partner or a relative who has lived in the property, as their main residence, for at least 12 months before death. The passing of the tenancy in these circumstances is called ‘succession’.
If the tenant was a successor (for instance, because he/she had succeeded on the death of a previous tenant, or because he/she was a joint tenant and had become the sole tenant) then the partner and relatives will not have the right to succession.
In some circumstances before granting a succession, consideration will also be given to the size of the property and the housing needs of the applicant..
